The AKA wants to make sure that kratom is still secure and lawful across the country by educating lawmakers. Creating the New York state kratom consumer protection legislation would be made possible by New York Senate Bill 3588 if it were to be passed. 

Senate Bill 3588 would:

  • Demand that sellers clearly label their kratom products with a description of the components and a recommended serving size.
  • Prohibit the use of harmful non-kratom ingredients such as synthetic alkaloids or controlled drugs.
  • Ban the selling of kratom to children (individuals under the age of 18)
  • Establish penalties for vendors who violate any requirements of the New York KCPA.
  • Require vendors to disclose the content of 7-hydroxy mitragynine and mitragynine on the packaging label
  • Prohibit the sale of kratom where 7-hydroxymitragynine makes up more than 2% of the kratom’s overall alkaloid content. For first-time offenders, the maximum fine is $500, and for repeat offenders, the maximum fine is $1000 for each successive offense.
  • In addition to facing a jail term of up to 90 days, vendors risk being held responsible for any damages that result from their carelessness.
